Welcome to Brillie.ai ("Brillie," "we," "our," or "us").

Please read these Terms of Service ("Terms") carefully before using the Brillie.ai website, mobile application, or AI tutoring services (collectively, the "Services"). By creating an account, purchasing a subscription, or using our Services, you agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THE SERVICES.

1. THE SERVICES & AI DISCLAIMER

Important Notice Regarding Artificial Intelligence:

Brillie is powered by advanced artificial intelligence. While we strive to provide a helpful and accurate tutoring experience, AI is probabilistic by nature.

• Accuracy: Brillie may occasionally produce incorrect, biased, or misleading information ("Hallucinations"). You acknowledge that Brillie is a study aid, not a replacement for classroom instruction, textbooks, or verified academic sources.
• No Guarantee of Results: We do not guarantee specific grades, test scores, or academic outcomes.
• Not Professional Advice: Brillie provides educational assistance only. It does not provide legal, medical, or financial advice.

2. ELIGIBILITY AND ACCOUNTS

• Age Requirement: You must be at least 13 years old to use the Services. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. If you are a parent or legal guardian of a user under the age of 18 (or the age of legal majority), you agree to be fully responsible for the acts or omissions of such user in connection with the Services.
• Account Security: You are responsible for maintaining the confidentiality of your login credentials. You notify us immediately of any unauthorized access to your account.

3. ACADEMIC INTEGRITY

Brillie is designed to help you learn, not to do your work for you. By using the Services, you agree to:

1. Use Brillie for study assistance, concept explanation, and practice.
2. Not use Brillie to generate essays, complete tests, or perform coursework in a manner that violates your school, university, or institution's academic honesty or plagiarism policies.
3. We reserve the right to terminate accounts that we discover are being used for academic dishonesty.

4. SUBSCRIPTIONS AND BILLING

• Free Trials: If you sign up for a free trial, you will be automatically charged for the subscription price at the end of the trial period unless you cancel 24 hours before the trial ends.
• Billing Cycle: Subscription fees are billed in advance on a recurring basis (monthly or annually).
• Cancellation: You may cancel your subscription at any time via your account settings. Cancellation is effective at the end of the current billing period. We do not offer refunds for partial billing periods.
• Price Changes: We may change our pricing with notice to you. Continued use after a price change constitutes acceptance.

5. ACCEPTABLE USE POLICY

You agree not to misuse the Services. Specifically, you will not:

• Use the Services to generate harmful, harassing, hate speech, or sexually explicit content.
• Attempt to "jailbreak," reverse engineer, or use prompt injection attacks against the AI model.
• Use the Services to develop a competing AI model or service.
• Scrape, spider, or use automated means to access the Services.

6. INTELLECTUAL PROPERTY

• Our IP: The interface, logo, software, and underlying algorithms of Brillie.ai are the property of Brillie.ai and its licensors.
• Your Input: You retain ownership of the text and queries you input into Brillie ("Input").
• AI Output: Subject to your compliance with these Terms, Brillie assigns to you all its right, title, and interest in and to the output generated by the Services in response to your Input ("Output").
• Use of Content for Training: To improve our educational models, you grant Brillie a worldwide, non-exclusive, royalty-free license to use your Input and Output to train, improve, and debug our AI models.

7. PRIVACY

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using the Services, you consent to our data practices.

8. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRILLIE.AI DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY ACCURATE.

9. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, BRILLIE.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU PAID US IN THE PAST TWELVE (12) MONTHS.

10. DISPUTE RESOLUTION (MANDATORY ARBITRATION)

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

• Binding Arbitration: Any dispute arising out of these Terms or your use of the Services will be resolved through binding arbitration, rather than in court.
• Class Action Waiver: You and Brillie.ai agree that any dispute must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
• Opt-Out: You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending a written notice to legal@brillie.ai.

11. TERMINATION

We reserve the right to suspend or terminate your access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

12. GENERAL TERMS

• Governing Law: These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
• Updates: We may update these Terms from time to time. If the changes are material, we will notify you via email or a prominent notice on the Service.
